1. Introduction & Agreement
Welcome to AquaVitae ("we," "us," "our"). We provide premium, naturally sourced mineral waters and related services. These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("the Client," "the Customer," "you") and AquaVitae. These Terms govern your use of our website (the "Site"), your purchase of our products, and your enrollment in any subscription or partnership service. By accessing our Site or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms in their entirety.
2. Eligibility
To purchase products or subscribe to services from AquaVitae, you must be at least 18 years of age and possess the legal authority and capacity to enter into a binding contract. You affirm that all information provided to us during the registration and checkout process is true, accurate, current, and complete.
3. Customer & Client Responsibilities
You, the Customer, agree to provide and maintain current, complete, and accurate information for your account and any orders placed. This includes, but is not limited to, your full name, a valid email address, a valid phone number, a correct and accessible delivery address, and accurate payment information.
It is your sole responsibility to ensure that someone is available to receive the delivery at the address provided during the scheduled delivery window. AquaVitae is not responsible for any loss, theft, or damage to products after they have been successfully delivered to the specified address. For hospitality and corporate clients, it is your responsibility to ensure that your premises can safely and securely accept palletized or large-volume deliveries.
4. Products, Orders & Availability
Placing an order through our Site constitutes an offer to purchase our products. An order is deemed confirmed only upon your receipt of an official order confirmation email from AquaVitae. All products are subject to availability. As our waters are natural products, slight variations in mineral content may occur between batches, which is a hallmark of their authenticity. We reserve the right to limit the quantities of any products or services that we offer.
5. Pricing, Billing, and Payment
All prices are quoted in the currency displayed on the Site and are subject to applicable taxes and shipping fees, which will be clearly itemized at checkout. Full payment is required at the time of ordering for single purchases.
For Subscriptions: By enrolling in a subscription, you authorize AquaVitae to charge your provided payment method on a recurring basis (e.g., monthly, bimonthly) for the agreed-upon subscription fee. The billing cycle will be clearly defined at the time of enrollment. You are responsible for keeping your payment information up to date in your customer portal.
6. Delivery & Shipping
All delivery and shipping timeframes provided are estimates. While we partner with reliable carriers, we are not liable for delays caused by factors beyond our reasonable control (e.g., carrier delays, severe weather, traffic). Our obligation is to deliver your order to the address you provide. Title and risk of loss for all products pass to you upon our delivery to the carrier. We are not responsible for orders that are undeliverable or misdelivered due to incorrect information provided by you.
7. Subscription Management, Cancellations & Refunds
You may modify, pause, or cancel your subscription at any time through your customer portal on our Site. To avoid being charged for the next scheduled shipment, any changes or cancellations must be made at least 48 hours prior to your next billing date.
- Due to the nature of our product, all sales are final. We do not accept returns.
- If you receive a damaged product (e.g., broken bottle), you must contact our customer support within 48 hours of delivery and provide photographic evidence of the damage. We will, at our discretion, issue a credit or send a replacement for the damaged items.
- Refunds or credits for any other issue are issued at our sole discretion and are reviewed on a case-by-case basis.
8. Intellectual Property
The "AquaVitae" name, logo, website design, text, graphics, photography, product names (e.g., 'Vesuvius Still', 'Alpine Soul'), and all other brand materials ("Brand Assets") are the exclusive intellectual property of AquaVitae and are protected by international copyright and trademark laws. We grant you a limited, non-exclusive, non-transferable license to access our Site for personal, non-commercial use. Any unauthorized use, reproduction, or distribution of our Brand Assets is strictly prohibited.
9. Limitation of Liability
To the fullest extent permitted by law, AquaVitae's liability for any claim arising out of your order or use of our services shall be limited to the total amount you have paid to us for the specific order or subscription period in question. In no event shall we be liable for any indirect, incidental, special, or consequential damages. We make no health claims about our products. Any information provided is for educational purposes only and should not be considered medical advice. We are not responsible for events of Force Majeure, including but not limited to acts of God, natural disasters, power outages, labor disputes, or other circumstances beyond our reasonable control that may disrupt service.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to its conflict of law principles. In the event of any dispute arising from these Terms or our services, you agree to submit to the exclusive jurisdiction of the state and federal courts located in Delaware.
11. Policy Updates
We reserve the right to update or modify these Terms & Conditions at any time without prior notice. The revised Terms will be posted on our Site, and the "Last Updated" date will be amended. Your continued use of our services or placement of an order after any such changes are posted constitutes your acceptance of the new Terms.
